ADULT ADOPTION $300; Court Fee: $20
Adult adoption is a legal procedure in which an older adult adopts a younger adult. Once the adoption is complete, a legal parent-child relationship is assumed by both parties, with all associated rights and responsibilities of such a relationship, including inheritance rights. ADULT ADOPTION CANNOT BE USED FOR IMMIGRATION PURPOSES!
DIVORCE/LEGAL SEPARATION $400; Filing Fee: $435
California is a “no fault” divorce state, which means that the spouse or domestic partner that is asking for the divorce does not have to prove that the other spouse or domestic partner did something wrong. To get a no fault divorce, one spouse or domestic partner has to state that the couple cannot get along. Legally, this is called “irreconcilable differences.”
EXPUNGEMENT $150; Filing Fee: $60 or $120
"Expungement" is a term used when referring to a process of cleaning up your criminal record. In this process you request that the court reopen your criminal case, withdraw the plea or guilty verdict, dismiss the charges, and re-close the case without a conviction. In effect, you are no longer a convicted person. Expungement is limited to cases in which the defendant convicted of a misdemeanor or a felony that could have been charged as a misdemeanor, and was sentenced to county jail time, probation, a fine, or a combination of those three. For a detailed list of exceptions see Penal Code (PC) § 1203.4, PC § 1203.4a, and PC § 1203.41.
SMALL CLAIMS ($10,000 or less) $300; Filing Fee: $75
Small claims court handles cases that involve disputes over money or property. If you are an individual and want to file a lawsuit for $10,000 or less, you have the option of filing in small claims court. Also of note, attorneys are not permitted to appear in small claims court.
NAME CHANGE $200; Filing Fee: $435
Name changes are common and usually easy to carry out. The court process can take up to three months. However, some courts are busier than others and it may take longer. Once the process is complete, you will get a court order called a 'decree' changing your name.
CHILD CUSTODY/VISITATION $300; Filing Fee: $435
In California, either parent can have custody of the children, or the parents can share custody. The judge makes the final decision about custody and visitation but usually will approve the arrangement (the parenting plan) that both parents agree on. If the parents cannot agree, the judge will make a decision at a court hearing.
